Consumer Health Data Privacy Policy
Effective October 27, 2026
This notice explains how ATA IT Services, LLC (dba Activate Fitness) handles "consumer health data" as defined by Washington, Nevada and Connecticut law. It supplements our Privacy Policy. "You" includes a parent acting for a child.
Health data we collect
| Category | Source | Why we collect it |
|---|---|---|
| Daily step count | Apple Health on your or your child's device, only with your permission | To count steps toward goals and award screen time (only steps recorded by the profile's own phone or chosen wearable count) |
| Exercise minutes and whether the Apple Watch Exercise ring was closed | Apple Health, only if an Apple Watch is selected and permitted | To award the optional Exercise Ring bonus |
| Figures derived from the above: goals completed, minutes earned, streaks, and a monthly Impact Report summary (average daily steps, active days and Exercise ring closures, for the month and for the 60 days before the profile started using Activate Fitness) | Calculated by the app | To show history, the Impact Report and streaks, and (only if the parent turns it on) to suggest a step goal |
We do not collect diagnoses, conditions, medications, heart rate, sleep, reproductive or sexual health information, biometric data, or precise location, and we do not draw health conclusions about anyone.
Sharing
We share consumer health data only with our service provider Google LLC (Firebase), which stores and processes it for us under a contract that limits its use to providing services to us, and with Apple as part of Apple Health. We have no affiliates that receive it. We do not sell consumer health data, and we do not share it with anyone else.
Consent
We collect consumer health data only after you grant permission in Apple Health and accept this notice in the app, and only for the purposes above. You can withdraw consent at any time by turning off Activate Fitness's access in the Health app (Sharing › Apps › Activate Fitness) or by emailing us. Withdrawing consent stops step and exercise tracking, so the Service will no longer award screen time.
Your rights
You may ask us to:
- Confirm whether we collect, share or sell your consumer health data, and give you access to it, including a list of every third party and affiliate we shared it with and how to contact them.
- Delete your consumer health data, including from our service provider. Deletion is completed from live systems promptly and from backups within 30 days.
- Withdraw your consent.
To use these rights, email andrew.armour@activatefitnessapp.com with the subject "Health Data Request," or call +1 (317) 604-9554. We will confirm your identity and respond within 45 days; if we need longer (up to 45 more days where the law allows), we will tell you why. Requests are free up to twice a year.
If we deny a request, you may appeal by replying with "Appeal" in the subject line. We will answer within 45 days. If you are not satisfied, you may contact the Washington Attorney General (atg.wa.gov), the Nevada Attorney General (ag.nv.gov), or the Connecticut Attorney General (portal.ct.gov/ag).
Other commitments
We do not use geofencing. No third party collects consumer health data about you through the Service over time or across other apps or websites. We do not discriminate against you for using these rights. Our staff and service providers who can access consumer health data are bound to keep it confidential and use it only as described here.
Changes to this notice
We will post any change here with a new effective date. Before we collect, use or share consumer health data in a materially different way, we will notify you by email or in the app and ask for your consent again.
